Discrimination certainly, but did it warrant a law suit? Once again the ACLU can smell an easy cash cow. My guess is they pocketed at least 40 or 50 percent of the payout, and without an argument. That school system didn't want a trial to bring further insult to injury and the ACLU knew it. While I am sure there are times when the ACLU certainly helps fight hurtful discrimination, don't see how this is one of those times...
