A lawsuit too far?

This article says that an atheist group is suing a school district because in its music program it uses songs with religious themes. Is this counter-productive? What about when a music teacher has a class listen to the Beethoven Mass for study purposes? Is this religious indoctrination?
Perhaps the atheist groups ought to choose their battles with a little more care?
