Personal suffering is just that. It's personal. Meaning no dollar value of compensation can ever be correctly mandated in any formulary regarding any given scenario. What is fair? What is not fair? There is no given. In the US it is wildly delegated... and promulgated, I might add. What is enough? or too much? Health lawsuits in the US are widely disparate. And yes, I will hear the arguments against this being a "health" lawsuit. Sorry everyone, but mental health is health.

The monetary payout on a multitude of malpractice/malfeasance lawsuits rests entirely upon the jury at that given moment - their emotions, their mental health, their health.

Bottom line, monetary settlements are usually eaten up by the lawyers - from the multitude of cases I have been privy to, the lawyers got 2/3 of the gross settlement and the plaintiff got 1/3. You will not read that in the headlines, articles, editorials or by-lines.

So, just exactly what is one's health worth? To me, it would be the national (and possibly world-wide headlines) attention brought forth with enough to pay for the legal fees and at least my health care to be ensured in my years to come. No expensive trips, no condos on the main, no 3-car garages, etc. Just simply to pay for my future health care in the US.
